Terms of Service (Canada)
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there.
1. What Mr.Diesel does
Mr.Diesel reads the fuel price files, fuel card statements and invoices you give it and shows you comparisons, maps, route suggestions and spend reviews worked out from them.
Mr.Diesel does not sell fuel, does not take a commission from any vendor or card, and does not act as your agent with any vendor.
A carrier based in Canada may use the service with Canadian and US price files alike. Canadian prices are shown in Canadian dollars per litre and US prices in US dollars per gallon; the two are never converted or compared with each other.
2. Your files and your data
You keep ownership of everything you upload or forward. You confirm you are allowed to use those files, including any vendor price file marked confidential, for your own fleet's purchasing decisions.
Price files forwarded to your Mr.Diesel email address are stored so you can open them again and so the service can learn their layout. They are used only to provide the service to you, and are never shared with another customer or with a vendor. Personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).
You can ask for your data to be deleted at any time, and it will be, except for records the law requires us to keep.
3. Prices move and the numbers are yours to check
Prices are the ones in the files you provided on the dates they were effective. They change at the pump and they change daily. A recommendation is worked out from your files and your volume, and it is a decision aid, not a guarantee of any price or saving.
Fuel tax figures, including IFTA, GST, HST and QST, are simplified estimates for comparison only and are not tax advice or a filing.
4. Your account
One sign-up is one fleet. Keep the sign-in link private; anyone with it can open your fleet's files. Tell us at once if you think someone else has it.
You are responsible for what is forwarded to your fleet's address and for who in your company you give that address to.
5. Fees
During the introductory period the service is provided at no charge. Any future fee will be shown to you in advance, in Canadian dollars, and only applies if you agree to it.
6. Limits of liability
The service is provided as is. To the fullest extent the law allows, Mr.Diesel is not liable for indirect, incidental or consequential loss, or for a purchasing decision made on the basis of a comparison, and its total liability to you is limited to the fees you paid in the twelve months before the claim. Nothing in these terms limits rights that consumer protection law in your province does not allow to be limited.
7. Changes and ending the service
We may update these terms; when we do, the version changes and you will be asked to accept the new one before continuing. Either of us can end the service at any time; your data is deleted on request as in section 2.
